TERMS AND CONDITIONS OF USE

Welcome to ALTRALINE ENGINEERING (“Company”, “we”, “our”, or “us”). These Terms & Conditions govern the use of services, products, websites, software platforms, communication systems, WhatsApp Official API integrations, RCS messaging services, and all associated digital solutions offered by ALTRALINE ENGINEERING.

By accessing, browsing, registering, purchasing, or using any service provided by ALTRALINE ENGINEERING, users, clients, customers, partners, or visitors (“User”, “you”, or “your”) agree to comply with and be legally bound by these Terms & Conditions in accordance with applicable laws of India.

If you do not agree with these Terms, you must discontinue the use of our services immediately.

1. INTRODUCTION

ALTRALINE ENGINEERING is engaged in providing engineering-related services, communication technology solutions, customer engagement systems, digital communication support, automation services, and business messaging solutions including integrations with Meta WhatsApp Business Platform and Rich Communication Services (RCS).

These Terms establish a legally binding agreement between ALTRALINE ENGINEERING and every individual or entity using our services.

Our services are intended solely for lawful business purposes and must not be used in violation of Indian laws, Meta policies, telecom regulations, or applicable data protection obligations.

2. DEFINITIONS

For the purpose of these Terms:

  • “Services” means all products, platforms, applications, communication systems, API integrations, automation tools, and business messaging services provided by ALTRALINE ENGINEERING.
  • “Platform” refers to websites, portals, dashboards, applications, APIs, or systems operated by ALTRALINE ENGINEERING.
  • “WhatsApp Official API” refers to messaging services provided through Meta-authorized communication channels.
  • “RCS” means Rich Communication Services enabled through telecom operators or authorized messaging providers.
  • “User Data” means all information, files, content, contacts, message templates, or communication data submitted by users.
  • “Account” means a registered profile or access credentials created to use our services.
  • “Applicable Laws” means laws, regulations, telecom rules, and data protection requirements enforceable within India.

3. ACCEPTANCE OF TERMS

By using the services of ALTRALINE ENGINEERING, you confirm that:

  • You are legally capable of entering into binding agreements.
  • You are authorized to represent your business or organization.
  • You will comply with all applicable laws and regulations.
  • You accept these Terms fully and without limitation.

Continued use of the services shall constitute ongoing acceptance of these Terms and any future amendments.

4. DESCRIPTION OF SERVICES

ALTRALINE ENGINEERING may provide:

  • Business communication solutions
  • WhatsApp Official API integrations
  • RCS messaging services
  • Automation and notification systems
  • Customer support communication tools
  • API-based integrations
  • Cloud communication support
  • Engineering consultation and digital infrastructure services
  • Messaging analytics and campaign management

The scope of services may change from time to time based on operational, technical, regulatory, or commercial requirements.

ALTRALINE ENGINEERING reserves the right to modify, suspend, discontinue, or enhance any service without prior notice.

5. ELIGIBILITY

To use our services, users must:

  • Be at least 18 years of age;
  • Possess legal authority to bind an organization if acting on behalf of a company;
  • Use services only for lawful commercial or authorized purposes;
  • Not be prohibited from accessing such services under applicable laws.

Services may not be used by individuals or entities involved in spam, fraud, misleading promotions, illegal content distribution, or unauthorized data collection activities.

6. ACCOUNT REGISTRATION

Certain services may require account registration.

Users agree to:

  • Provide accurate and updated information;
  • Maintain confidentiality of login credentials;
  • Restrict unauthorized access to their account;
  • Notify ALTRALINE ENGINEERING immediately in case of security breaches.

Users remain solely responsible for all activities conducted through their accounts.

ALTRALINE ENGINEERING reserves the right to suspend or terminate accounts that contain false information, suspicious activity, or policy violations.

7. USER RESPONSIBILITIES

Users agree not to:

  • Send spam, unsolicited messages, or deceptive communications;
  • Violate Meta, telecom, or RCS messaging policies;
  • Upload harmful code, malware, or malicious content;
  • Infringe intellectual property rights;
  • Engage in unlawful marketing practices;
  • Use purchased or unauthorized contact databases;
  • Send messages without recipient consent.

Users are fully responsible for obtaining valid opt-ins and permissions from recipients before sending communications through WhatsApp Official API or RCS channels.

Users must comply with:

  • Meta Business Messaging Policies;
  • WhatsApp Commerce Policies;
  • Telecom Regulatory Authority of India (TRAI) regulations;
  • Applicable anti-spam and consumer protection laws.

8. PAYMENT & BILLING TERMS

Users agree to pay all applicable fees associated with the services subscribed to.

Billing may include:

  • Platform subscription fees;
  • API usage charges;
  • Communication delivery charges;
  • Setup or onboarding fees;
  • Maintenance fees;
  • Third-party integration charges.

Payments must be completed within the agreed due date.

Failure to make timely payment may result in:

  • Service suspension;
  • Restricted platform access;
  • Termination of account;
  • Additional recovery actions permitted by law.

Unless otherwise agreed in writing, all payments are non-refundable.

Taxes, including GST where applicable, shall be borne by the user.

9. SUBSCRIPTION RENEWAL & TERMINATION

Certain services may operate on recurring subscription models.

Subscriptions may automatically renew unless cancelled before the renewal date.

ALTRALINE ENGINEERING reserves the right to terminate or suspend services if:

  • Terms are violated;
  • Fraudulent activity is detected;
  • Regulatory violations occur;
  • Payment obligations remain unpaid.

Users may request cancellation by contacting the Company through official communication channels.

Termination does not relieve users from outstanding payment obligations accrued prior to cancellation.

10. USE OF WHATSAPP OFFICIAL API & RCS

Users utilizing WhatsApp Official API or RCS services agree to comply with:

  • Meta Business Terms;
  • Meta Commerce Policies;
  • WhatsApp Messaging Guidelines;
  • Telecom operator regulations;
  • TRAI regulations;
  • Applicable communication laws.

Users must ensure:

  • Proper recipient consent;
  • Transparent message content;
  • Non-deceptive communication;
  • Accurate sender identification;
  • Lawful campaign execution.

ALTRALINE ENGINEERING does not guarantee approval, uninterrupted access, or permanent availability of WhatsApp or RCS services, as such services are dependent on third-party providers and platform policies.

Meta, telecom operators, or authorized providers may suspend accounts or reject templates that violate applicable policies.

11. MESSAGE DELIVERY & COMPLIANCE POLICY

Message delivery depends on several external factors including:

  • Network availability;
  • Telecom operator infrastructure;
  • Recipient device compatibility;
  • Meta platform restrictions;
  • Recipient preferences;
  • Internet connectivity.

ALTRALINE ENGINEERING does not guarantee:

  • Instant message delivery;
  • Delivery success rates;
  • Read receipts;
  • Platform uptime;
  • Continuous API availability.

Users are solely responsible for message content and campaign compliance.

Any misuse involving spam, phishing, illegal promotions, or deceptive communication may result in immediate suspension.

12. INTELLECTUAL PROPERTY RIGHTS

All content, software, branding, logos, designs, APIs, dashboards, documentation, and proprietary systems belonging to ALTRALINE ENGINEERING remain the exclusive intellectual property of the Company.

Users shall not:

  • Copy;
  • Reverse engineer;
  • Resell;
  • Reproduce;
  • Modify;
  • Distribute;
  • Exploit

any proprietary material without prior written permission.

Limited usage rights are granted solely for authorized business use of the services.

13. CONFIDENTIALITY

Both parties agree to maintain confidentiality regarding:

  • Business information;
  • Pricing;
  • Customer data;
  • Technical configurations;
  • Internal communications;
  • Proprietary systems.

Confidential information shall not be disclosed to unauthorized parties unless required by law or regulatory authorities.

This obligation survives termination of services.

14. DISCLAIMER OF WARRANTIES

Services are provided on an “as-is” and “as-available” basis.

ALTRALINE ENGINEERING does not warrant that:

  • Services will be uninterrupted;
  • Systems will be error-free;
  • Platforms will remain continuously available;
  • Delivery rates will meet expectations;
  • Third-party services will function without disruption.

No warranty, express or implied, is provided regarding merchantability, fitness for a particular purpose, or uninterrupted operation.

15. LIMITATION OF LIABILITY

To the maximum extent permitted under Indian law, ALTRALINE ENGINEERING shall not be liable for:

  • Indirect damages;
  • Consequential losses;
  • Revenue loss;
  • Data loss;
  • Business interruption;
  • Reputation damage;
  • Regulatory penalties caused by user misconduct;
  • Third-party platform suspension.

The Company’s aggregate liability shall not exceed the amount paid by the user for services during the preceding three months.

16. INDEMNIFICATION

Users agree to indemnify and hold harmless ALTRALINE ENGINEERING, its directors, employees, affiliates, and partners from claims, losses, liabilities, penalties, damages, or expenses arising from:

  • Violation of these Terms;
  • Unlawful communications;
  • Spam complaints;
  • Regulatory breaches;
  • Intellectual property infringement;
  • Unauthorized data processing.

This includes legal costs and attorney fees incurred in defending such claims.

17. GOVERNING LAW (INDIA)

These Terms shall be governed and interpreted in accordance with the laws of India.

Any disputes arising from these Terms shall fall under the jurisdiction of competent courts located in Maharashtra, India.

Users agree to attempt amicable resolution before initiating formal legal proceedings.

18. CHANGES TO TERMS

ALTRALINE ENGINEERING reserves the right to modify these Terms at any time.

Updated Terms may be published on official platforms or communicated electronically.

Continued use of services after updates constitutes acceptance of revised Terms.

Users are encouraged to review these Terms periodically.
